Food&Good SAS, a simplified joint-stock company registered in France, offers digital solutions for restaurant professionals, including
:- reservation
management – customer
relationship management – payment and
prepayment – marketing and communication
– customer
review management – website creation
These General Terms and Conditions of Service (GTCS) define the terms and conditions of use of these services.
They apply to all professional customers subscribing to the services offered by Food&Good SAS.
2. Purpose
The purpose of these terms and conditions is to define
:- the conditions of access to
Food&Good services- the rights and obligations of the
customer- the financial
conditions- the responsibilities of each party
The contract consists of
:- these general
terms and conditions – the quote or purchase order accepted by the customer
.In the event of a contradiction, the quote shall prevail.
3. Acceptance of terms
Any subscription to the services implies
:- reading
– understanding
– unreserved acceptance of these general terms and conditions.
This acceptance may be given
:- by manual or electronic
signature- by validating a quote-
by using the service
4. Term of the contract
The contract takes effect on the date of validation of the quote or use of the service(s).
Unless otherwise specified, it is concluded for an initial term of 12 months, automatically renewable for the same term.
The customer may terminate the contract
:- at least 60 days before the expiry date by registered letter with acknowledgment of receipt sent to the registered office of Food and Good SAS
.- Any subscription period that has already begun remains payable.
5. Description of services
Food&Good provides a platform that allows, in particular:
5.a – Management of reservations
The customer may
:- receive
online reservations – manage
their tables and availability – centralize their reservations (website, telephone, networks, partners).
5.b – Customer file
The platform allows you to create and manage a customer database including
:- reservation
history – customer
contact details – customer preferences
5.c – Review collection
After a visit, customers of the establishment can receive a message allowing them to leave a review.
These reviews can be
:- viewed
– analyzed
– published on the restaurant's website.
5.d – Marketing tools – paid option
The customer can send their customers or prospects
:- emails-
text
messages- promotional campaigns
5.e – Payment and prepayment
The platform can enable
:- online
payment or security deposits
– bank
card details – prepayments – the sale of gift vouchers.
These payments are processed via secure payment providers.
5.f – Website creation
Food&Good can offer a website creation and hosting service for the establishment.

Food&Good can offer a mini-website creation and hosting service for the establishment on its www.foodandgood.fr platform.
6. Access to customer account
The customer has a secure account accessible via a username and password.
The customer is responsible
for:- the confidentiality of their access
details – the use of their account – the actions carried out by their employees.
7. Customer obligations
The customer undertakes to
:- provide accurate information
– use the services in
accordance with the law – not interfere with the
functioning of the platform – not introduce viruses or malware.
The customer is solely responsible
for:- their relationship with their customers
– the content they publish on the platform.
8. Customer content
The customer may publish
:- photos-
menus-
texts-
offers and commercial information directly related to the establishment concerned.
The customer guarantees
:- that they have the necessary
rights – that this content does not infringe any third-party rights.
The customer authorizes Food&Good to use all of their content to
:- provide services
– promote the restaurant on the platform.
9. Financial terms
The services are offered on a subscription basis.
The rates are indicated in the quote accepted by the customer.
Payments can be made by
:- direct debit
– credit card
Invoices are payable within 30 days.
10. Late payment
In the event of late payment
:- penalties may be applied-
services may be suspended-
the contract may be terminated
.- A fixed collection fee may also be applied in accordance with regulations.
11. Personal data
Personal data may be processed in connection with the use of the services.
Each party undertakes to comply with the applicable regulations, in particular the GDPR.
The customer remains responsible for the data of its own customers.
12. Liability
Food&Good undertakes to provide its services with diligence and professionalism.
However
:- Food&Good is only bound by an obligation of means
– the company does not guarantee an increase in turnover or customer base.
– Food&Good's liability is limited to proven direct damages.
It cannot be held liable
for:- loss of revenue
– loss of data
– indirect damage.
13. Intellectual property
All elements belonging to Food&Good (software, databases, trademarks, logos, etc.) remain its exclusive property.
The customer only has the right to use them for the duration of the contract.
14. Commercial references
The customer authorizes Food&Good to mention
:- the name of the
restaurant – its logo
– its visuals
as a commercial reference throughout the duration of the contract and up to 36 months after the date of termination of the contract, regardless of the reason.
15. Termination of the contract
At the end of the contract
:- access to the services is interrupted
– certain data may be returned upon request.
16. Force majeure
Neither party shall be held liable in the event of force majeure preventing the performance of the contract.
17. Applicable law and disputes
These terms and conditions are governed by French law.
In the event of a dispute, the parties shall attempt to find an amicable solution before any legal proceedings.
In the absence of an agreement, the competent courts shall be those of the jurisdiction of the registered office of Food&Good SAS at the time of the dispute.
